Agreement
These Terms of Use (the "Terms") are an agreement between you and the makers of Tagalog with Kikay ("the app," "we," or "us"). "The app" includes both the mobile app and the browser-based web player. By downloading, installing, or using either, you agree to these Terms. If you do not agree, please do not use the app. Because the app is made for children, a parent or guardian is responsible for accepting these Terms and supervising their child's use.
License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on devices you own or control, for your family's personal, non-commercial learning and entertainment. This license is subject to these Terms and to the rules of the app store you downloaded it from.
What you may not do
You agree not to copy, sell, rent, sub-license, or redistribute the app; not to modify, reverse-engineer, decompile, or disassemble it except where the law expressly permits; and not to remove any copyright or ownership notices. You also agree not to use the app in any way that breaks the law or interferes with its normal operation.
Ownership
The app, including its characters (such as Kikay and Butchong), artwork, audio, lessons, and software, is owned by us or our licensors and is protected by copyright and other laws. These Terms give you a license to use the app; they do not transfer any ownership to you.
Purchases and subscriptions
The app is free to download and try, and offers an optional Premium subscription that only a grown-up can choose to buy. For purchases made in the iOS app, payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same price and period unless it is cancelled at least 24 hours before the current period ends. Renewal is charged within 24 hours before the current period ends. You can manage or cancel the subscription anytime in your App Store account settings. App Store purchases and entitlement status are handled by Apple and RevenueCat, the service we use to manage subscriptions. Prices and periods are shown before purchase and may vary by region. Restore Purchases is available in the app.
Optional household accounts
A grown-up may create one household account for one family, linked to the parent's email address. The parent can sign in on up to 3 devices at a time by requesting a sign-in code sent to that email. The account supports family profile and learning-progress synchronization; it is separate from Apple ID purchase processing. Keep the email account secure and do not share sign-in codes outside your household. Accounts belong to grown-ups: creating an account and signing in sit behind the parental gate, and children cannot create or manage accounts.
Refunds
App Store purchases are processed by Apple under Apple's policies; we cannot issue refunds for them — please contact Apple for refund requests. Cancelling a subscription stops future charges but does not entitle you to a refund of amounts already paid. Nothing in this section limits any non-waivable statutory rights you may have where you live.
Privacy
The app does not ask children for personal information, and a child's gameplay never requires an account. A child's progress is always saved on their own device, and while a grown-up is signed in to an optional household account it is also stored on our own server so it follows the family to other devices. We process the parent's email address, consent, session/device data, and synced profile/progress only to operate that household service. A grown-up can delete the household and everything stored for it at any time from the For Grown-Ups screen. How we handle all data is described in our Privacy Policy, which forms part of these Terms. Children and family use
The app is designed for children and families and is meant to be used with a parent or guardian's involvement. Grown-up actions, including buying a subscription, sit behind a parental gate. A parent or guardian is responsible for their child's use of the app and for these Terms.
Disclaimer of warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. We do not warrant that the app will be uninterrupted or error-free.
Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Nothing in these Terms limits any rights you have that cannot be limited by law.
Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date shown below. Continuing to use the app after an update means you accept the revised Terms.
Children's privacy (COPPA)
The app is directed to children under 13 and complies with the U.S. Children's Online Privacy Protection Act (COPPA). We do not collect, use, disclose, or sell personal information from children. A child's progress — words learned, stars, and stickers — is stored on their device and, while a parent is signed in to a household account, on our server under a random household identifier; it is not sold, used for advertising, or sent to analytics services. No account is required for a child to play. A parent may voluntarily provide an email address to create a household account. Parents and guardians may at any time: (1) review what we hold by emailing support@tagalogwithkikay.com; (2) request deletion of all data we hold for their household — profile, progress, and email — by using "Delete our data from the server" in the For Grown-Ups screen or by emailing support@tagalogwithkikay.com; and (3) refuse further collection by deleting their household account. We will respond to all parental requests within 30 days. We do not sell, rent, or share children's information with third parties.
Intellectual property ownership
All characters (including Kikay and Butchong), artwork, illustrations, audio recordings, music, lesson content, software, and other creative elements in the app are original works authored by AuraDev TechLab LLC. Some elements were created with the assistance of artificial intelligence tools under the direct creative direction and authorship of AuraDev TechLab LLC; such works are protected by copyright to the fullest extent permitted by applicable law. Nothing in the app uses licensed third-party characters, trademarks, or copyrighted content without authorisation. "Tagalog with Kikay," "Kikay," and "Butchong" are proprietary names of AuraDev TechLab LLC. You may not reproduce, distribute, publicly display, or create derivative works from any content in the app without our prior written permission.
Dispute resolution and arbitration
Please contact us first at support@tagalogwithkikay.com — most concerns can be resolved quickly and informally. If a dispute cannot be resolved informally, you and we agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. BY AGREEING TO THESE TERMS YOU WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. Either party may bring a claim in small claims court for disputes within that court's jurisdictional limit. To opt out of arbitration, you must send written notice to support@tagalogwithkikay.com within 30 days of first using the app; your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms. Nothing in this section prevents either party from seeking emergency injunctive relief in court to protect intellectual property or confidential information pending arbitration.
Governing law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. For any claim or dispute not subject to arbitration under these Terms, you and we consent to exclusive jurisdiction and venue in the state or federal courts located in Florida. If you are a consumer in a jurisdiction whose law requires that a different law apply or that disputes be resolved in a different forum, that law or forum governs to the extent required.
